Overview

Upgrade Medical (“we,” “our,” or “us”) is committed to protecting the privacy and security of patient information. This Patient Communication Privacy Policy Addendum describes how we handle information related to patient communications conducted through text message (SMS), voice calls, push notifications, patient portal messaging, and email.

This addendum supplements our primary Privacy Policy and applies specifically to all forms of electronic and digital communication with patients.

Scope of Communications

We may communicate with patients through the following channels:

  • SMS (text messaging)

  • Voice calls (including automated or prerecorded messages)

  • Push notifications

  • Secure patient portal messaging

  • Email communications

These communications may include, but are not limited to:

  • Appointment reminders and scheduling updates

  • Care coordination messages

  • General health-related information

  • Administrative notifications

Consent to Communications

By providing your contact information and engaging with our services, you consent to receive communications from Upgrade Medical through the channels listed above, in accordance with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA).

Patients may opt out of non-essential communications at any time by following the instructions provided in the message or by contacting us directly.

Data Privacy and Information Handling

We are committed to minimizing data collection and protecting patient confidentiality:

  • No Retention of Communication Data: We do not retain or store the content of patient communications beyond what is necessary to deliver the communication service.

  • No Sale of Personal Information: We do not sell, rent, or share patient information with third parties for marketing purposes.

  • Minimum Necessary Standard: Any information used is limited to what is necessary to perform communication-related functions.

Secure Transmission: Communications are transmitted using commercially reasonable safeguards designed to protect data integrity and confidentiality.

HIPAA Compliance

Where applicable, Upgrade Medical adheres to the standards set forth under the Health Insurance Portability and Accountability Act (HIPAA):

  • Protected Health Information (PHI) is handled in accordance with HIPAA requirements.

  • Communication vendors and service providers are required to maintain appropriate safeguards and, where necessary, enter into Business Associate Agreements (BAAs).

  • Patients should be aware that certain communication channels (e.g., standard SMS or email) may not be fully secure, and by consenting to their use, acknowledge and accept these risks.

Third-Party Service Providers

We may utilize third-party communication platforms to facilitate messaging and notifications. These providers are contractually obligated to:

  • Maintain confidentiality and security of any transmitted information

  • Comply with applicable healthcare privacy laws and regulations

  • Use information solely for the purpose of providing communication services

User Responsibility

Patients are responsible for:

  • Providing accurate and up-to-date contact information

  • Not sharing sensitive personal information through unsecured channels unless necessary

  • Notifying us of any unauthorized use of their communication channels

Opt-Out and Communication Preferences

Patients may opt out of receiving communications at any time:

  • SMS: Reply “STOP” to unsubscribe

  • Email: Use the unsubscribe link (if applicable)

  • Other communications: Contact our support team

Please note that opting out of certain communications may impact our ability to provide services effectively.

While we implement industry-standard safeguards, no method of electronic communication is completely secure. By choosing to communicate with us via electronic means, you acknowledge and accept this inherent risk.

Regulatory Compliance

Upgrade Medical complies with all applicable federal, state, and local regulations governing patient communications and data privacy, including but not limited to:
